Residential premises
GOV.UK states that enforcement agents usually cannot force entry to collect ordinary civil debts and cannot enter through anything except the door. Reasonable force may be available in defined cases, including collection of certain unpaid criminal fines, Income Tax or Stamp Duty, and under specific court-authorised or re-entry provisions.
Commercial premises and re-entry
Entry to trade or business premises may engage different statutory provisions. Re-entry after goods have been taken into control is not the same as first entry. A controlled goods agreement, prior entry, a warrant permitting force, the type of debt and whether the premises are wholly or partly residential may all matter.
Safe practical response
- Ask which debt and statutory power is relied upon.
- Ask whether the person says this is first entry, re-entry or possession enforcement.
- Keep doors and windows secure if you choose not to admit the agent.
- Do not physically obstruct, assault or trap the agent.
- Record any attempt to use force and obtain urgent advice if the asserted power is unclear.
