Company debts and enforcement at a director's home
A director is not ordinarily personally liable for a limited company's debt without a separate legal basis. An agent may nevertheless attend premises where the company trades or keeps goods.
Only goods in which the debtor company has the relevant interest may generally be controlled. Keep personal invoices, bank records and finance agreements; do not create false receipts or transfer bound goods.
A personal guarantee, separate judgment or misconduct order changes the analysis. Third-party claims, damages and costs require the correct procedure and evidence.
