Paying a judgment creditor during High Court enforcement

Direct payment to the creditor does not automatically remove the HCEO's entitlement to fees or end enforcement. The effect depends on timing, stage and settlement terms.

Obtain a statement from the HCEO and written settlement terms covering interest, fees and when the writ will be stayed or withdrawn. Send proof of payment immediately.

An application to vary or set aside the judgment does not itself stay the writ. Seek a separate stay where required.
